Entry to the Sweepstakes is conditional upon acceptance of the terms and conditions outlined herein (“Official Rules”). By entering the Sweepstakes, you will be deemed to have read and accepted these Official Rules.
1. SWEEPSTAKES DESCRIPTION:The Lyca Mobile Dealers Take a Break! Sweepstakes (the “Sweepstakes”), sponsored by Lycamobile USA Inc. (the “Sponsor”), is a sweepstakes by which you may be eligible to win one of nine $500 cash prizes.
2. ENTRY PROCESS: To participate in the Sweepstakes for a chance to win a prize, eligible persons must do one of the following during the Submission Period (as defined below): (a) activate a Lyca Mobile SIM card with plan using the Lyca Mobile Point of Sale (POS) system; or (b) legibly handwrite on a postcard their full legal name, date of birth, address of legal residence, email address and phone number and mail it with proper postage to Lycamobile, 24 Commerce Street, Suite 100, Newark, NJ 07102. Mailed entries must be postmarked by January 10, 2023 and received by Sponsor no later than January 15, 2023 to be considered for the Sweepstakes. The completeness of an entry shall be determined by Sponsor, at its sole discretion. Each postcard is considered one (1) entry into the Sweepstakes. No mechanical reproductions will be accepted. Write-in entries must contain all entry fields outlined above; otherwise, they are void and will not be eligible to win.
3. ELIGIBILITY: The Sweepstakes is open to legal residents of the USA who are over or the age of majority in their state of residence (which is nineteen (19) in Alabama, Nebraska, twenty-one (21) in Mississippi, and eighteen (18) in all other states) as of the date of entry (the “Entrant”). Void outside of the fifty (50) United States, the District of Columbia, Puerto Rico, and where prohibited, taxed or restricted by law. Entrants must be owners of a retail location with a Lyca Mobile Hot Spot account, supported by the Lyca Mobile Hot Spot sales team (“Dealer”). To be eligible to participate in the Sweepstakes, Dealers must have a “DD” in front of their Lyca Mobile retailer ID. Employees of Sponsor or its affiliates and each of their respective immediate families (defined for the purpose of these Official Rules as husband, wife, mother, father, sister, brother, son, daughter, or persons residing in the household of such employees), are not eligible to participate. The Sponsor reserves the right to verify the eligibility of Entrants and check their identity.
4. DISQUALIFICATION: Sponsor has the right to disqualify any entry that does not comply with these Official Rules or that is otherwise suspected of failing to comply with the fairness and integrity of this Sweepstakes.
5. SUBMISSION PERIOD: Sweepstakes submissions will be accepted from December 13, 2022 to January 15, 2023 midnight EST (“Submission Period”).
6. WINNER SELECTION & NOTIFICATION: Sponsor will select nine (9) winners from all eligible and complete entries received during the Submission Period to receive a prize. Each winner will be randomly selected by a random drawing to be held within one (1) week after the Submission Period. Each winner will be notified within 48 hours of the drawing by email or phone call confirmation and the winner names will be posted on the Sponsor’s Website or the Lyca Mobile POS system.
7. PRIZE: Each prize winner will receive a $500 cash prize, either as a gift card or in the form of a business check. Total approximate value of all prizes: $4,500. Total prizes: 9. Odds of winning depend on the number of eligible entries received. The value associated with the prizes is taxable as income. Winners will be solely responsible for all fees and taxes (federal, state, local and/or income) associated with the acceptance of the prizes and all expenses not listed related to acceptance and use of the prize (including airfare, transfers or accommodations). No transfer, substitution or assignment of prize permitted, except by Sponsor, which reserves the right to substitute a prize, in whole or in part, for one of comparable or greater value due to unavailability or for any reason, as solely determined by Sponsor.
8.COLLECTION OF PRIZE:All prizes will be delivered to the winners either by hand, via electronic means or by Federal Express to the address listed in Lyca Mobile’s POS system for the winning Dealers. Method of prize delivery will be selected by Sponsor at its sole discretion and the prize must be accepted as awarded or else forfeited.
9. PUBLICITY RELEASE: By entering the Sweepstakes, Entrants agree to the use of their names, likenesses, photographs, voices, sounds, images and biographical information by Sponsor for any and all purposes in any and all media without further consent or payment. By entering the Sweepstakes, Entrants agree to participate in any publicity campaigns at the request and discretion of Sponsor.
10. DISCLAIMER OF LIABILITY; RELEASE: : Sponsor has organized this Sweepstakes in good faith and does not accept any liability relating to the prize structure or prizes. Sponsor is not responsible for providing prizes for entries lost, illegible, stolen, incomplete, delayed or destroyed. Sponsor is not responsible for any failures of any kind or problems or delays arising from any technical, software or equipment malfunctions, congestion on or unavailability of any service during the Sweepstakes period or otherwise, any other technical, equipment or human errors of any kind that result an Entrant’s inability to participate in the Sweepstakes. Proof of submission will not be deemed to be proof of receipt by Sponsor. By entering into this Sweepstakes, Entrants hereby release and discharge Sponsor and its affiliates and agents, representatives, independent contractors, officers, employees and directors (“Released Parties”) from and against any and all claims, liabilities, costs, damages and expenses of any kind arising out of or relating to their participation in this Sweepstakes, their use or acceptance of any prize and/or any actions or decisions of Sponsor in connection with the conduct and administration of this Sweepstakes. Entrants hereby waive any right to seek injunctive or other equitable relief in connection with any claim against the Released Parties.
11.INTEGRITY OF THE SWEEPSTAKES. If an Entrant attempts to compromise the integrity or the legitimate operation of this Sweepstakes by hacking or by cheating or committing fraud in ANY way, Sponsor may seek damages from that Entrant to the fullest extent permitted by law. Further, the Entrant’s entry to this Sweepstakes will be disqualified and Sponsor may ban the Entrant from participating in any future sweepstakes. If Sponsor determines, in its sole discretion, that there is any suspected or actual evidence of fraud relating to any portion of the Sweepstakes, or if technical difficulties compromise the integrity of the Sweepstakes, Sponsor reserves the right to cancel, terminate, modify or suspend the Sweepstakes, in whole or in part, at any time without notice.
CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. SPONSOR’S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS.
12. DISPUTES & BINDING ARBITRATION: In the unlikely event of a dispute, the Sponsor’s decision shall be final and binding in all matters relating to this Sweepstakes. If any provision or part of these Official Rules is deemed void or otherwise unenforceable in law, then that provision or part shall be deemed excluded and the remainder shall remain in force. The terms and conditions outlined in these Official Rules, the conduct of this Sweepstakes and the interpretation and enforcement hereof, shall be exclusively governed and construed in accordance with the laws of the United States. All federal, state and local laws and regulations apply. The Sweepstakes is void where prohibited by law. By entering the Sweepstakes, Entrants agree that exclusive jurisdiction for any dispute, claim, or demand related in any way to the Sweepstakes will be decided by binding arbitration in the Newark, New Jersey, USA area. The parties agree to share equally in the arbitration costs incurred.
THE ARBITRATION OF DISPUTES PURSUANT TO THIS PARAGRAPH SHALL BE IN THE ENTRANT’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED. DO NOT ENTER THIS PROMOTION IF YOU DO NOT AGREE TO HAVE ANY CLAIM OR CONTROVERSY ARBITRATED IN ACCORDANCE WITH THESE OFFICIAL RULES.
